Land and technical examination is one of the types of engineering and technical expertise.This type of examination is officially approved by the Ministry of Justice of Ukraine and approved by the Instruction on the appointment and conduct of forensic examinations and expert studies.
In preparing for the appointment of land and technical expertise and formulating questions, a person who appoints the expert examination should provide an expert with the materials that are the subject of aninvestigation.
Judging from a practice, in the course of appointing a forensic land-technical expert assessment, the following issues can be highlighted:
1) Does the border of plot oflandwith a total area of 0.198 hectares with a designated purpose for construction and maintenance of a residential house located in the Borodyankaurban village, belonging to P, comply with the boundaries indicated in the state act on the right of private ownership of land of the I-KV series under No. 0, issued on 29.07. 2012?
2)Do the borders of plots of land with an area of 0.10 hectares with a designated purpose forthe management of a personal farming, cadastral number 32 …….., and an area of 0.25 hectares for the purpose of construction and maintenance of an apartment house, cadastral number 32 ………, belonging to M, under contracts of Purchase and Sale from 11.05.2012, comply withthe boundaries of these plots of landindicated in the title documents?
3)Do the borders of plots of land with an area of 0.25 hectares with a designated purpose forconstruction and maintenance of a residential houseby the cadastral number 32 ……. and area of 0.452 hectares with purpose forthe management of a personal farming, cadastral number 32 ………, belonging to C, under contracts of Purchase and Sale from 11.05.2012, comply withthe boundaries of these plots of landindicated in the title documents?
4)Do the coordinates of plots of land,belonging to P, specified in the title documents coincide with the coordinates indicated in the title documents of plots of land,belonging to M?
5)Do the coordinates of plots of land,belonging to P, specified in the title documents coincide with the coordinates indicated in the title documents of plots of land,belonging toC?
6)Are there overlaps of plots of land between themselves, belonging to a plaintiff and a defendant M, C, if so, what is the area of overlap?
7)Are there plots of land located at the address Kiev region, Borodyanskyi district, with the following cadastral numbers:
– plot of land with total area of 1.5103 hectares, cadastral number 3221;
– plot of land with total area of 1.7651hectares, cadastral number 3222;
– plot of land with total area of 1.5099hectares, cadastral number 3223;
– plot of land with total area of 0.7551hectares, cadastral number 3224;
– plot of land with total area of 0.7550 hectares, cadastral number 3225;
– plot of land with total area of 0.7551hectares, cadastral number 3226;
– plot of land with total area of 0.7550hectares, cadastral number 3227, belonging to theLimited Liability Company “L”, and
– plot of land with total area of 0.7551hectares, cadastral number 3228, belonging to theLimited Liability Company “U”, as such lands formed from the following plots of land:
– plot of land with total area of 1.5100hectares, cadastral number 3229, located at the address: Kiev region, Borodyanskyi district?
